BMW E46 track-day hire terms.

The practical rules for using the Afiléon Motorsport E46 on a supported circuit day.

Vehicle Hire Terms version: 28 September 2026 (v9.2).

Read together. These terms supplement the General Booking, Payment, Cancellation & Refund Terms and apply specifically to the Afiléon Motorsport BMW E46 Arrive & Drive package.

1. Scope of hire

The BMW E46 Arrive & Drive package is a full-day supported track-day vehicle-hire service for the specific circuit and date stated in the booking confirmation. The vehicle is supplied for the booked event only and remains under Afiléon Motorsport supervision. It is not an unsupervised road-rental vehicle.

2. What the package includes

Unless the booking confirmation states otherwise, the package includes the E46, vehicle preparation, circuit transport to the selected standard circuit, one full tank of fuel and Afiléon Motorsport trackside monitoring/support throughout the booked event. The package price does not include the track-day admission, event-entry or organiser fee. The customer is responsible for independently securing and paying for a valid place on the relevant track day with the circuit or event organiser. Any such entry fee is a separate transaction between the customer and the relevant third party and does not form part of the Afiléon Motorsport package price, unless Afiléon Motorsport expressly confirms otherwise in writing. Additional fuel is also excluded unless expressly included.

3. Meaning of “full day”

“Full day” means the standard full-day event period made available by the relevant circuit or organiser. It does not mean 24 hours, unlimited continuous driving, or a guaranteed number of laps, sessions, miles or minutes on circuit.

Available driving time is subject to registration, briefing, noise testing, organiser timetable, queues, red flags, stoppages, weather, circuit instructions, recovery activity and reasonable checks for tyres, brakes, fluids, wheels, cooling, refuelling and vehicle condition. Customer-side lost time is not added to the end of the event.

4. Reservation and preparation

Once the booking has been accepted and the booking deposit paid, Afiléon Motorsport may dedicate calendar capacity and begin preparation of the E46, transport and equipment. The booking deposit and customer-cancellation rules in the General Booking Terms therefore apply.

5. Named driver and eligibility

Only the driver named in the booking and accepted by Afiléon Motorsport and the circuit/organiser may drive. The vehicle must not be handed to an unauthorised driver.

The driver must hold and produce a valid driving licence or other driving entitlement acceptable for the event, comply with the organiser's age and eligibility requirements, complete any required declaration and provide requested documents by the deadline stated in the booking confirmation or General Booking Terms.

The organiser's rules always take precedence. Afiléon Motorsport may refuse release or participation where the eligibility requirements are not satisfied.

6. Driver declaration and fitness to drive

Before hire, the driver must read and accept the Driver Eligibility & Event-Day Declaration. The driver confirms that their licence/entitlement is genuine and current, that they have disclosed relevant restrictions or eligibility issues, and that they will obey organiser and Afiléon Motorsport instructions.

The driver must not drive while impaired by alcohol, illegal drugs, misuse of medication, fatigue or any other condition the driver knows makes safe participation unreasonable. The driver must immediately report a change in fitness that could affect safe driving.

7. Driver care standard

The driver must drive within their own capabilities, follow circuit rules and flags, use reasonable mechanical sympathy and take reasonable care of the vehicle and equipment. Deliberate abuse, reckless conduct, unauthorised drifting where prohibited, intentional over-revving, repeated misuse after warning, or continued driving after a clear mechanical warning may result in the E46 being stopped or the hire being terminated.

8. Three driver safety declarations during the day

At points designated by Afiléon Motorsport during the hire day, the driver may be required to sign or electronically acknowledge a continued-use declaration. The declaration is a safety and incident-reporting control, not a waiver of Afiléon Motorsport's obligations and not proof that a hidden fault cannot exist.

The driver may be asked to confirm whether the brakes, steering and stability feel normal and whether there are warning lights, unusual noises, vibration, movement, smells, smoke, leaks, contact, off-track excursions, missed shifts, over-revs or other abnormal behaviour.

9. Stop and report if something changes

If an unusual sound, movement, vibration, braking/steering change, warning light, overheating, fluid loss, tyre problem or other concern develops, the driver must report it as soon as safely possible. The driver must not continue solely to avoid losing track time where doing so could worsen damage or create a safety risk.

10. Afiléon inspection and release decisions

Following a report or scheduled check, Afiléon Motorsport may mark the vehicle CLEARED, HOLD, STOP — DO NOT DRIVE, or CLEARED WITH RESTRICTION. The driver's wish to continue does not override a reasonable safety decision by Afiléon Motorsport or the circuit.

11. Pit-lane incident reporting and evidence

Following an incident or abnormal symptom, Afiléon Motorsport may create an incident record including session/lap/time, symptoms, warning lights, noises, vibration, contact, immediate action, photographs, vehicle status and mechanic sign-off. The driver must provide honest and complete information and cooperate with reasonable inspection and evidence-gathering.

12. Insurance position

Track-day damage insurance is not automatically included unless checkout or the written booking confirmation expressly says so. Where insurance is included or arranged, the applicable policy exclusions, limits and excess apply in addition to these terms.

Where no insurance is stated, the driver must not assume that accidental damage to the E46, circuit barriers, recovery equipment or third-party property is insured.

13. Normal wear and driver-caused damage

Normal wear reasonably expected from proper permitted track use is included to the extent intended by the package. The driver may be responsible for the reasonable cost of damage caused by collision or barrier contact, leaving the circuit surface, deliberate or reckless abuse, ignoring a safety instruction or warning, continuing after a clear fault warning, an avoidable missed shift or over-rev, or avoidable tyre/wheel damage.

In assessing any claim, Afiléon Motorsport will take account of pre-existing condition, ordinary wear, reasonable repair cost, betterment and amounts recovered from insurers or responsible third parties so that the customer is not charged twice for the same loss.

14. £2,500 damage security and card pre-authorisation

Before the E46 is released, the hirer must provide a valid payment card and permit a separate £2,500 damage-security pre-authorisation, unless the booking confirmation expressly states a different amount. This is separate from the £250 booking deposit and is normally a temporary reservation of funds rather than an immediate payment.

Afiléon Motorsport may use all or part of the authorised amount only for reasonable sums arising directly from the hirer's use of the vehicle, including customer-caused collision damage, misuse or avoidable driver error; wheel, tyre or suspension damage; missing or damaged vehicle equipment; reasonable recovery, towing, vehicle transport, storage, inspection, diagnostic or specialist-assessment costs; direct circuit/venue/third-party charges for which the hirer is responsible; and other direct, reasonably foreseeable loss resulting from a material breach of these terms.

The security will not be used for ordinary wear and tear, deterioration arising from normal permitted track use, pre-existing damage, inherent mechanical defect, or loss caused by Afiléon Motorsport's own breach or negligence.

The damage-security amount is not a maximum liability cap. Where a properly evidenced loss for which the hirer is legally responsible exceeds the security, Afiléon Motorsport may seek the reasonable outstanding balance, subject to applicable law and these terms.

15. Evidence and use of the security

Afiléon Motorsport will not make an arbitrary or punitive deduction. Where reasonably practicable, any amount captured or claimed will be supported by pre- and post-hire photographs, vehicle condition records, circuit incident reports, invoices, quotations, diagnostics, specialist assessments, recovery invoices, telemetry or other relevant records.

If an incident requires immediate recovery, towing, storage, inspection or another reasonable protective action, Afiléon Motorsport may take that action without waiting for prior approval where necessary to protect the vehicle, persons or property. Only reasonable costs actually incurred or reasonably expected to be incurred may be recovered.

Where there is reasonable evidence that an amount is due and the payment authorisation would otherwise expire, Afiléon Motorsport may capture a reasonable evidence-based amount and reconcile it once final costs are known. A written itemisation will be supplied.

16. Release of unused security

Where no damage or charge is identified, Afiléon Motorsport will instruct its payment provider to release the pre-authorisation within 2 business days after the post-hire inspection. The customer's bank or card provider controls when the reserved funds become available again and may take additional time.

If an incident or third-party charge requires investigation, Afiléon Motorsport will notify the hirer as soon as reasonably practicable and release any part of the security that is clearly not required. The remaining amount will be released or reconciled once the necessary evidence and costs can reasonably be established.

17. Recovery, betterment and no double recovery

Afiléon Motorsport will take reasonable steps to minimise losses arising from an incident. The hirer will not be charged for unnecessary, disproportionate or unrelated expenditure. Any recovery from an insurer, circuit or responsible third party for the same loss will be taken into account.

18. Mechanical failure attributable to the vehicle

If a vehicle fault within Afiléon Motorsport's responsibility prevents the service from starting, and no agreed substitute or replacement date is accepted, the customer will receive a full refund of sums paid for the unprovided E46 service.

If a material fault occurs after part of the service has already been provided, Afiléon Motorsport will assess fairly what was supplied and what could not be supplied. Where appropriate, the remedy may include a proportionate refund, replacement date, or credit for the unprovided element.

This section does not convert normal vehicle checks, cooling, tyre-pressure adjustments, incident assessment or reasonable maintenance pauses into a service failure.

19. Customer cancellation, lateness and failed eligibility

If the customer cancels, fails to provide required licence/eligibility evidence, is refused participation for a customer-side reason, arrives too late, misses a mandatory briefing or does not attend, the General Booking Terms apply. The booking deposit will normally be retained to the extent of the reasonable direct net loss caused.

20. Safety withdrawal

Afiléon Motorsport may pause or withdraw the E46 from use because of a safety or mechanical concern, a circuit instruction, unsafe weather or surface conditions, or unreasonable abuse. Where the vehicle is withdrawn because of a customer-caused issue, that may be treated as a customer-side failure to use the service. Where withdrawal is caused by an Afiléon-responsibility vehicle fault, the mechanical-failure provisions above apply.

21. Tyres, fuel and consumables

One full tank of fuel is included unless the booking confirmation states otherwise. Additional fuel is chargeable unless included. Normal tyre wear is included; avoidable damage such as severe flat spots, puncture damage caused by continuing to drive on a deflated tyre, or impact-related wheel damage may be charged where the driver is responsible.

22. Circuit and third-party charges

The driver must follow circuit incident procedures. Afiléon Motorsport may pass on a circuit or third-party charge that arises directly from an incident for which the customer is legally responsible, provided the amount is evidenced and recoverable.

23. Vehicle condition and post-hire inspection

Afiléon Motorsport may record the E46's condition before and after the event, including tyres, brakes, fluids, bodywork, wheels and mileage. Pre-existing condition will be taken into account when assessing any later damage claim.

24. Statutory rights and liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence. Consumer statutory rights remain in force.

25. Governing terms and law

Payment, deposit, cancellation and rescheduling are governed by the General Booking Terms. The law of England and Wales applies, subject to any mandatory consumer jurisdiction rights.
