Customer Vehicle Transport & Recovery Terms.
Clear rules from collection to delivery.
Customer Vehicle Transport & Recovery Terms version: 7 October 2026 (v1.2).
These terms apply to trailer-based collection, loading, carriage, unloading and delivery of customer vehicles by Afiléon Motorsport. They should be read with the Booking Terms. Vehicle recovery jobs are also subject to the Vehicle Recovery Terms, which take priority on a recovery-specific issue if there is a conflict.
1. Booking and authority
You confirm that you own the vehicle or have the owner's authority to arrange its transport. Where a vehicle is leased, financed, hired or belongs to another person or company, you are responsible for obtaining any permission needed. We may request reasonable evidence of identity and authority before collection.
2. Information you must give us
You must give accurate information about the vehicle, including make/model, approximate weight and dimensions, ground clearance, whether it starts, steers, brakes and rolls, and any modification or defect that could affect safe loading or securing. Please disclose low splitters, side skirts, diffusers, air suspension, seized wheels, fluid leaks, damaged tyres, unusual towing points, competition fuel systems, accident damage and any known electric/hybrid high-voltage battery concern.
3. Quotes and additional work
Quotes are based on the information supplied, route, access, timing and expected loading requirements. A quote may change if the information is materially inaccurate, the route or addresses change, exceptional waiting is required, additional recovery/winching is needed, or another material circumstance arises that could not reasonably have been priced beforehand. Any extra charge must reflect genuine additional work, cost or delay.
4. Preparing the vehicle
The vehicle must be available at the agreed collection place and time. Remove valuables and unnecessary loose items. Supply the keys, immobiliser fobs, towing eye or other equipment reasonably needed to move the vehicle. Tell us about alarms, isolation switches and any unusual starting or movement procedure.
5. Collection condition record and photos
Before loading we will normally make a reasonable visual condition record and take photographs of the accessible exterior, wheels/tyres, relevant existing damage and other useful areas. This is not a mechanical, structural or valuation inspection. Dirt, rain, darkness, restricted access or vehicle position can prevent defects from being visible. At unattended collection we will make our own record where reasonably practicable.
6. Loading and unloading
We will use reasonable care and skill when loading and unloading. We may start, steer, brake, winch or manoeuvre the vehicle only as reasonably necessary for transport. We may refuse to load a vehicle where weight, dimensions, ground clearance, tyre condition, access or mechanical condition makes the operation unsafe or creates an unreasonable risk of damage.
7. Securing the vehicle
Afiléon Motorsport chooses and applies the securing method. Depending on the vehicle and trailer this may include rated wheel restraints, straps, chocks, winching equipment or other appropriate restraints. We may stop to inspect or adjust the load. A customer instruction will not be followed if we reasonably consider it unsafe.
8. Pre-existing and inherent faults
We are not responsible merely because an existing defect, corrosion, weak trim/bodywork, tyre defect, electrical fault, flat battery, suspension fault, internal engine/transmission problem or other inherent mechanical issue becomes apparent while the vehicle is with us. This does not apply where our handling caused or materially contributed to the damage or failure.
9. Modified, competition and high-risk vehicles
You must disclose special jacking/towing points, composite bodywork, very low clearance, centre-lock wheels, competition suspension, fuel cells and any special loading instructions. We may require additional arrangements or decline a movement that cannot be completed safely with the available equipment.
10. Personal property and spares
The service is for the vehicle unless we agree otherwise. Cash, valuables, documents and irreplaceable items should not be left inside. Spare wheels, tools or motorsport equipment are only part of the consignment if agreed and must be safely secured.
11. Declared value and insurance
We may ask for an estimated vehicle value for risk assessment; that figure is not automatically an agreed valuation. Customers should maintain whatever vehicle cover they consider appropriate and check whether transport by a commercial carrier affects that cover. Any goods-in-transit, carrier's liability or other insurance stated by Afiléon Motorsport is subject to the actual insurer's terms, exclusions and limits. We will not claim that a vehicle is insured up to a particular value unless that cover has been confirmed.
12. Our responsibility while the vehicle is in our custody
We will perform the service with reasonable care and skill. We are responsible for direct physical loss or damage to the extent caused by our negligence, failure to exercise reasonable care and skill, or another breach of contract. That includes negligent loading, securing, transport or unloading. Where repair is appropriate, compensation is normally assessed by the reasonable cost of returning the vehicle as closely as practicable to its pre-loss condition, without unnecessary betterment.
13. Business losses
For business customers, and subject to liability that cannot lawfully be limited, we do not accept responsibility for indirect or consequential commercial loss such as lost profit, sponsorship, opportunity or reputation. Unless a critical event deadline is expressly accepted in writing, race entry, testing, track hire and similar third-party costs are not guaranteed against transport delay.
14. Delays and journey times
Collection and delivery times are estimates unless expressly guaranteed in writing. Traffic, weather, road closures, emergency restrictions and venue delays can affect transport. We will take reasonable steps to communicate material delays and minimise delays within our control. Tell us before booking if the vehicle must arrive by a critical deadline.
15. Events outside reasonable control
Neither party is responsible for delay caused by a genuine event outside reasonable control where reasonable precautions could not have avoided the consequences. A mechanical breakdown of our equipment is not automatically outside our control: we remain responsible for appropriate maintenance and for taking reasonable action if a breakdown occurs.
16. Mileage, route, waiting and redelivery
Transport mileage will be calculated using a reasonable and practicable road route suitable for the Afiléon Motorsport tow vehicle and trailer combination, taking account of relevant vehicle dimensions, weight, road restrictions, access limitations and other operational requirements. Afiléon Motorsport currently uses Magic Earth as its navigation and routing system, but may replace or supplement it with another suitable navigation and routing system without changing the basis on which mileage is calculated.
Distances displayed by standard car-navigation services such as Google Maps or Apple Maps may not be suitable for a towing or vehicle-transport combination and do not automatically determine the chargeable mileage. Where a commercially suitable route is longer because it avoids unsuitable, restricted or impractical roads, the mileage charge will be calculated using that reasonable suitable route.
The mileage and transport price will normally be agreed before the journey. Reasonable additional charges may apply where we are ready to perform the service but are materially delayed by circumstances attributable to the customer, including missing keys, blocked access, incorrect addresses, an unavailable recipient or an undisclosed defect, or where the customer requests a change to the collection point, delivery destination, agreed arrangements or additional stops. Any additional charge must reflect reasonable extra time, mileage, storage or work.
17. Customer cancellation
For customer vehicle transport and recovery, this section replaces any different general cancellation timetable in the Booking Terms. More than 7 days before collection, we will normally refund the transport payment less any reasonable, irrecoverable third-party costs already committed specifically for the booking. Between 48 hours and 7 days before collection, we may retain or charge up to 25% of the booked transport price; between 24 and 48 hours, up to 50%; and less than 24 hours before collection, or where the vehicle is not made available, up to 100%. These are maximums rather than automatic penalties: we will consider costs saved, whether the slot was resold and our actual reasonable loss, and we will not recover more than the reasonable loss and committed costs resulting from cancellation. Where applicable law gives a consumer stronger rights, those rights take priority. Transport of goods booked for a specific date or period may fall within an exception to the ordinary distance-contract cooling-off regime.
18. Cancellation or refusal by Afiléon Motorsport
We may cancel, suspend or refuse transport that cannot safely or lawfully be performed, including where the vehicle differs materially from its description, access is unsafe, legal weight/dimension limits would be exceeded, a vehicle presents an undeclared hazard, or behaviour at collection/delivery is abusive or threatening. If we cancel for reasons not caused by the customer, sums paid for the affected service will be refunded.
19. Breakdown, incident and emergency action
If our towing vehicle, trailer or equipment becomes unusable, we may arrange recovery, alternative transport or a secure location. If the customer vehicle itself creates an unexpected safety hazard, we may move it to a safe or secure place. We will notify the customer of a material incident as soon as reasonably practicable.
20. Storage
If delivery cannot safely be completed because an authorised recipient is unavailable, access is blocked or delivery instructions change, the vehicle may be taken to a reasonably secure location. Reasonable additional transport and storage costs attributable to the customer may be charged after notification. We will continue to exercise reasonable care while the vehicle remains in our custody.
21. Delivery and handover
We will normally make a further condition/photo record at delivery and give the recipient a reasonable opportunity to inspect the vehicle. A delivery acknowledgement confirms receipt but does not prevent a genuine claim for damage that could not reasonably have been identified at handover. Unattended delivery will only be made where authorised and clear key/handover instructions have been provided.
22. Damage reporting
If you believe damage occurred while the vehicle was in our custody, contact team@afileonmotorsport.co.uk as soon as reasonably possible. Visible damage should preferably be reported immediately or within 24 hours so evidence can be preserved. Please provide photographs and details. Unless urgent work is needed to prevent further damage or make the vehicle safe, give us a reasonable opportunity to inspect before permanent repair.
23. Records and subcontractors
We may retain condition photos, delivery records, registration details and correspondence for operational, insurance, fraud-prevention and dispute-resolution purposes in line with our Privacy Policy. Where reasonably necessary we may use a suitably competent subcontractor; for consumer bookings, subcontracting does not remove our contractual responsibility for the service we agreed to provide.
24. Statutory rights, governing law and complaints
Nothing in these terms excludes liability that cannot lawfully be excluded, including death or personal injury caused by negligence. Consumer services must be performed with reasonable care and skill, and consumer terms remain subject to statutory fairness requirements. Complaints should be sent to team@afileonmotorsport.co.uk. These terms are governed by the law of England and Wales, without removing any mandatory consumer right to use another court available under applicable law.
