Vehicle Recovery Terms.
Recovery-specific terms for non-runners, breakdowns, damaged vehicles and other vehicles requiring trailer collection.
Vehicle Recovery Terms version: 7 October 2026 (v1.2).
1. Scope of the recovery service
Afiléon Motorsport provides planned, trailer-based vehicle recovery where the job can be carried out safely and lawfully with the equipment available. Unless expressly agreed in writing, this is not 24-hour roadside assistance, roadside repair, live-lane motorway recovery, emergency rescue or a guarantee of immediate attendance. A vehicle in a dangerous position must first be made safe by the emergency services, highway authority or a suitable emergency-recovery operator.
2. When a recovery becomes a booking
An enquiry, estimate, message or indication of availability is not a confirmed dispatch. A recovery becomes binding only when Afiléon Motorsport has accepted the job, the required payment or deposit has been received where requested, and the essential collection, destination and vehicle details have been agreed. We may make acceptance conditional on photographs, location details or further information.
3. Customer authority and lawful possession
You confirm that you own the vehicle or have full authority from the owner or lawful keeper to arrange its recovery and delivery. You must disclose any finance, lease, police, insurer, recovery-yard, storage-yard or third-party restriction that may affect release or movement. You are responsible for obtaining any release authority, gate pass, keys, identification or other permission required at collection or delivery.
4. Accuracy of the information supplied
Our quote and decision to attend rely on the information you give us. You must accurately disclose the vehicle's make/model, approximate weight and dimensions, location, access, ground clearance, whether it starts, rolls and steers, any brake failure or other braking defect, tyre/wheel condition, accident damage, missing wheels, seized components, fluid leaks, modifications and any other fact that may affect safe recovery. If information is materially wrong or incomplete, we may revise the price, require different equipment, suspend the job or refuse the recovery.
5. Access and recovery location
You are responsible for giving accurate access information and for having any permission reasonably required to enter private land, car parks, workshops, compounds or controlled sites. The collection and delivery areas must provide enough safe and lawful space for the towing vehicle, trailer, ramps, winch and loading operation. We are not required to enter a location, manoeuvre on ground, or obstruct a road where we reasonably believe it would be unsafe, unlawful, likely to cause damage or unsuitable for the equipment.
6. Vehicle condition and hazardous vehicles
You must tell us about fuel leaks, oil or coolant loss, fire damage, flood damage, unstable bodywork, sharp or loose panels, damaged wheels or suspension, deployed airbags, chemical contamination, LPG systems, motorsport fuel cells, battery damage and any other known hazard. We may refuse, suspend or abandon a recovery if the vehicle presents an undeclared or unacceptable safety, fire, environmental or contamination risk. Reasonable costs already incurred because of inaccurate or incomplete information remain payable to the extent permitted by law.
7. Authority to move, steer, brake and operate the vehicle
By instructing us, you authorise Afiléon Motorsport to enter the vehicle where reasonably necessary and to use keys, steering, brakes, transmission controls, ignition, battery isolators, handbrake, neutral-release procedures, towing eyes and other ordinary controls solely for recovery, loading, securing, unloading and delivery. We may reposition the vehicle by hand, winch or other suitable recovery method where reasonably required.
8. Winching, dragging and non-rolling vehicles
Where a vehicle has seized brakes, locked wheels, collapsed suspension, damaged steering, missing keys or another defect preventing normal rolling, recovery may require skates, winching, controlled dragging or other additional methods. We will use reasonable care and skill, but you acknowledge that a pre-existing defect can make some further marking, tyre movement, component loading or deterioration unavoidable even when the recovery is performed competently. We are not responsible for damage caused solely by the vehicle's pre-existing condition or an inherent defect; this does not exclude responsibility for damage caused by our negligence or failure to use reasonable care and skill.
9. Low, modified, historic and competition vehicles
You must identify unusually low splitters, side skirts, undertrays, exhausts, aero, air suspension, composite panels, centre-lock wheels, race suspension, non-standard towing points, delicate trim and any special starting or loading procedure. Clearance measurements supplied by you are relied upon. If additional ramps, timber, skates, specialist equipment or additional labour are reasonably needed, the recovery may be repriced or declined.
10. Electric and hybrid vehicles
You must disclose that a vehicle is electric or hybrid and any suspected traction-battery damage, overheating, smoke, impact to the battery enclosure, immersion, warning messages or isolation issue. Afiléon Motorsport may refuse any vehicle where a high-voltage battery hazard is suspected and may require attendance by a suitably equipped specialist before transport.
11. Accident-damaged vehicles
Acceptance of an accident-damaged vehicle is always subject to condition and safe loading. We may require photographs before dispatch. A vehicle may be refused if its structure, wheels, suspension, battery, fuel system, bodywork or debris makes loading or transport unsafe. We do not provide accident investigation, vehicle inspection, repair assessment or confirmation that a vehicle is safe to drive.
12. Keys, wheel locks and release arrangements
You must provide all keys, immobiliser devices, wheel-locking keys, neutral-release instructions and access codes reasonably needed for the agreed service. Missing items may cause delay, additional work or refusal. If a third-party site refuses to release the vehicle, our attendance and waiting may still be chargeable where the failure is not caused by Afiléon Motorsport and the applicable charge was disclosed or otherwise lawfully recoverable.
13. Personal property and prohibited contents
Unless expressly agreed, recovery covers the vehicle only. Remove cash, valuables, documents and irreplaceable property. You must not leave unlawful, dangerous, explosive, corrosive or inadequately secured goods in the vehicle. Spare wheels, tools or motorsport equipment are carried only where agreed and safely secured. We do not accept responsibility for undisclosed items except to the extent loss or damage is caused by our negligence and liability cannot lawfully be excluded.
14. Quote basis and additional charges
A quote is based on the facts known when it is issued. Additional reasonable charges may apply for customer-requested route changes, extra mileage, tolls or access charges, materially longer loading, additional winching, specialist loading measures, waiting, redelivery, storage or other work caused by circumstances not included in the agreed quote. Where practicable we will explain additional charges before carrying out non-urgent extra work.
15. Attendance, aborted recovery and customer-caused failure
Where the quote or booking confirmation identifies an attendance, call-out, mobilisation or minimum charge, that amount becomes payable once we have dispatched or committed resources to attend. If we arrive and cannot complete the recovery because the vehicle or access materially differs from the information supplied, required keys or authority are unavailable, the vehicle has already been removed, the customer or releasing party is unavailable, or the site is unsafe for reasons not caused by Afiléon Motorsport, we may charge the disclosed attendance amount together with reasonable additional costs actually incurred.
16. Waiting time
Waiting beyond the time included in the quote may be charged at the rate stated in the quotation or booking confirmation where the delay is attributable to the customer, the owner, a garage, storage yard, insurer, venue or another party for whom the customer is responsible. We may leave the site rather than continue waiting where doing so is operationally necessary or safer, and a return visit may be separately chargeable if agreed.
17. Mileage, route and destination changes
Any mileage charge will be calculated using a reasonable and practicable road route suitable for the Afiléon Motorsport recovery vehicle and trailer combination, taking account of relevant vehicle dimensions, weight, road restrictions, access limitations and other operational requirements. Afiléon Motorsport currently uses Magic Earth as its navigation and routing system for this purpose, but may replace or supplement it with another suitable navigation and routing system without changing the basis on which mileage is calculated.
A commercial-vehicle route may be longer than the shortest route shown by standard car-navigation services such as Google Maps or Apple Maps. Where this occurs because the shorter route is unsuitable, restricted or impractical for the recovery combination, the chargeable mileage will be based on the reasonable commercially suitable route.
Where reasonably practicable, the chargeable mileage and resulting recovery price will be confirmed with the customer before dispatch. Once confirmed, that mileage will normally remain the basis of the agreed charge even if the route actually travelled changes because of traffic, road closures, diversions or similar circumstances. A customer-requested change to the collection point, delivery destination, agreed route, extra stop or other material recovery detail may result in a reasonable additional charge.
18. Priority Recovery fixed-price service
Where Afiléon Motorsport publishes a Priority Recovery option, that service is a premium fixed-price alternative to Standard Recovery and does not replace the normal quote-based service. The currently published Kent Track Priority Recovery price is £700 fixed for an eligible collection from Brands Hatch, Lydden Hill or another eligible Kent motorsport venue, with delivery up to 100 suitable-route miles from the agreed collection venue.
The 100-mile limit is measured using the same suitable-route basis described above for the recovery vehicle and trailer. The customer must provide the essential collection, destination, vehicle-condition and contact details requested at checkout and must confirm the destination is believed to fall within the included limit. If the suitable recovery route is subsequently found to exceed 100 miles, the fixed-price Priority Recovery service does not apply; Afiléon Motorsport may offer Standard Recovery pricing instead or refund the Priority Recovery payment if the service is not provided.
Priority Recovery purchases priority handling and removal of the normal quotation step; it does not create an absolute guarantee of attendance or require Afiléon Motorsport to undertake an unsafe, unlawful, impossible or unsuitable recovery. Acceptance remains subject to current operational availability, safe access, vehicle suitability, equipment capability and the other provisions of these Vehicle Recovery Terms. The same liability allocation and statutory-right safeguards apply to Priority Recovery as to Standard Recovery.
Where Afiléon Motorsport is unable to accept or provide a paid Priority Recovery for reasons attributable solely to Afiléon Motorsport, the unprovided service will be refunded. Where the recovery cannot proceed because customer information was materially inaccurate, the destination falls outside the published limit, access is unsuitable, the vehicle requires equipment outside the published service, or another customer-side condition prevents performance, the position will be handled under these terms and applicable consumer law.
19. Payment and release
Payment is due at the stage stated in the quote or booking confirmation, and Afiléon Motorsport may require full or partial cleared payment before dispatch, before loading or before release of the recovered vehicle. Any undisputed additional amount properly due under the agreed terms must be paid when invoiced. A genuine dispute about one item does not remove the obligation to pay other undisputed sums.
20. Cancellation and commencement of work
Recovery booked for a specific date or period may fall within the statutory exception that applies to transport of goods on a specific date or period. Where a statutory cancellation right does apply and you ask us to begin the service during the cancellation period, we may require your express request and acknowledgement before starting. If you then cancel after work has begun, you may have to pay a proportionate amount for the service supplied up to cancellation; once a service has been fully performed after the required request and acknowledgement, the statutory cancellation right may end. Any stronger statutory right takes priority over these terms.
21. Our right to refuse, suspend or stop the recovery
We may refuse, suspend or stop a recovery where continuing would in our reasonable judgment be unsafe, unlawful, beyond the safe capability of the equipment, likely to cause disproportionate damage, involve an undisclosed hazard, expose staff or property to abuse or threats, or require a service that was not agreed. Where the issue was caused by inaccurate customer information or another customer-side failure, reasonable committed and attendance costs may remain payable. Where the refusal is solely our responsibility, we will refund the unprovided part of the service.
22. Subcontractors and alternative arrangements
Where reasonably necessary, we may use a suitably competent subcontractor or arrange alternative recovery or storage. For consumer bookings, subcontracting does not remove Afiléon Motorsport's contractual responsibility for the service it agreed to provide. We may choose alternative equipment or methods where reasonably required for safety or operational reasons.
23. Delivery failure and storage
If delivery cannot be completed because the recipient is unavailable, access is blocked, the destination refuses the vehicle, payment due before release has not been made, or instructions change, we may take the vehicle to a reasonably secure location. Reasonable redelivery, additional mileage and storage charges may be payable where the failure is attributable to the customer and the applicable charges have been disclosed or are otherwise lawfully recoverable. We will continue to exercise reasonable care while the vehicle remains in our custody.
24. Uncollected vehicles
You must take delivery or provide workable delivery instructions when reasonably requested. If a vehicle remains uncollected, we may charge reasonable storage and take the steps available to a bailee under applicable law, including the Torts (Interference with Goods) Act 1977, after giving any notice required by law. Any lawful sale or disposal process will be subject to the statutory safeguards and accounting requirements that apply.
25. Collection and delivery times
Times are estimates unless we expressly guarantee a time in writing. Traffic, incidents, weather, closures, venue delays, loading difficulty and other events can change arrival times. Tell us before acceptance if a deadline is critical. We do not guarantee attendance or delivery by a race, track session, ferry, workshop slot or other third-party deadline unless that deadline is expressly accepted in writing as part of the booking.
26. Our liability
We will perform the recovery with reasonable care and skill. We are responsible for direct physical loss or damage to the extent caused by our negligence, failure to exercise reasonable care and skill or other breach of contract. We are not responsible merely because an existing defect, corrosion, structural weakness, tyre defect, mechanical failure, electrical fault, battery condition, damaged suspension, weak trim or other inherent problem becomes apparent during recovery. Nothing in these terms excludes liability for death or personal injury caused by negligence or any other liability that cannot lawfully be excluded or restricted.
27. Business and consequential losses
For business customers, and subject to liability that cannot lawfully be limited, we do not accept liability for indirect or consequential loss, loss of profit, revenue, opportunity, sponsorship, reputation, race entry, test fees, track fees or third-party downtime arising from delay or inability to complete a recovery unless that specific exposure was expressly accepted by us in writing before the booking.
28. Customer-caused loss or damage
If inaccurate information, an undisclosed hazard, unsafe contents, leakage, defective parts or another breach of your obligations directly causes reasonable damage, cleaning cost, third-party charge or other direct loss to our vehicle, trailer or equipment, you are responsible for that loss to the extent caused by your breach or negligence and to the extent permitted by law. We will take reasonable steps to mitigate loss and will not charge for unrelated betterment.
29. Damage reports and inspection
If you believe damage occurred while the vehicle was in our custody, notify us as soon as reasonably possible and provide photographs and relevant information. Visible damage should preferably be raised at handover or within 24 hours so evidence can be preserved, but this is not an absolute time bar on a genuine claim. Unless urgent work is needed to prevent further loss or make the vehicle safe, please give us a reasonable opportunity to inspect before permanent repair. We may ask for estimates, invoices or an independent assessment.
30. Photographs and records
We may take photographs or video of the vehicle, recovery location, loading arrangement, securing points, existing damage, delivery condition and relevant access for operational, insurance, fraud-prevention and dispute-resolution purposes. Records are handled in accordance with our Privacy Policy.
31. Business-customer indemnity
If you book in the course of business, you will indemnify Afiléon Motorsport against reasonable third-party claims, penalties, costs and direct losses arising from your lack of authority to move the vehicle, materially inaccurate information, undisclosed hazardous contents or your breach of these terms, except to the extent the loss was caused or increased by Afiléon Motorsport's own negligence or breach.
32. Consumer protection and fairness
If you are a consumer, these terms do not reduce rights that the law says cannot be excluded. Consumer services must be performed with reasonable care and skill, and consumer contract terms remain subject to statutory fairness and transparency requirements. Any term that cannot lawfully bind a consumer is to be read subject to those rights rather than as an attempt to remove them.
33. Governing law and complaints
Complaints should be sent to team@afileonmotorsport.co.uk. These terms are governed by the law of England and Wales, without removing any mandatory consumer right to use another court available under applicable law.
